In 1792, the city of Cádiz, in response to the poor distribution, situation and construction of the old prison, determined the construction of a new one, in a more ventilated area and with a capacity proportionate to the population. It was designed in 1794 by Torcuato Benjumeda, the most representative of all the architects who work in the city, at a time when the economic decline begins and in which the Neoclassical is in fashion, in contrast to the previously in force Baroque, which is now considered decadent and even tacky. The total cost of the works was 3.5 million reais.
The plans are dated 1794, the year in which the works began. However, they must be later, since Benjumeda signs with the title of Academic of Merit, a title that was not granted until 1807. The city is also cited as Very Heroic, a title that was granted to the city of Cádiz in 1816 .
The building began to be used in 1836, when a large part of it was finished by the architect Juan Daura, leaving the last section to be finished, the one closest to the sea, which was not finished until 1990, in the rehabilitation carried out for the Ministry of Justice by J. Montes Deza, to enable it as the seat of the Courts, which saved it from a state of almost ruin. Following the original plans, the last bay of the building was completed and it is installed as a finish in the advanced body of the main facade, a rectangular attic and a large shield with two pinnacles on the sides.
Today it is unknown what the future of this building will be, without a doubt, the masterpiece of the Andalusian Neoclassical.
Building with a rectangular ground plan, measuring 66.87 by 33.45 meters and perfectly symmetrical, which is organized according to a square central courtyard and two other smaller rectangular ones on the sides, around which the cells and other units are distributed on two floors. Tall.
In elevation it has two floors, with an advanced central body. Tuscan pilasters, of a giant order (banded on a basement) frame the openings. The windows on the ground floor, with greater light, have a simple horizontal-trace dust cover, which descends concave at its ends. An entablature runs over the pilasters, in whose frieze there are triglyphs and under them three drops.
The central body of the façade has four attached Tuscan columns, plus two pillars at the ends, of the same order. On the smaller sides of the central body, on the openings of the ground floor (and framed by pilasters), blind semicircles are distributed, on which an oculus is inscribed.
Above the main cover there was an inscription that read: ´´Hate the crime, sympathize with the delinquent´´, a phrase due to Concepción Arenal. Romero de Torres in his Monumental Catalog of Spain - Province of Cádiz, considered it as ´´the civil building with the best architectural taste in Cádiz´´ and ´´if it were not for the aforementioned legend, one might think that it would have been built for a museum or literary center´´.
